Terms and Conditions

These Terms and Conditions govern your access to and use of ASAP Motion, including the website, editor, templates, generation tools, rendering tools, export tools, project storage, and related services available through https://asapmotion.co and any linked product surfaces that reference these Terms.

1. Agreement to these Terms

By creating an account, clicking to accept, or otherwise accessing or using ASAP Motion, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a company, agency, or other entity, you represent that you have authority to bind that entity, and "you" includes both you and that entity.

2. Eligibility and account registration

You must be at least 13 years old, or the minimum age required to consent to online services where you live, to use ASAP Motion. If you are under 18, you may use the Service only with permission from a parent or legal guardian.

You must provide accurate account information, keep your credentials secure, and promptly update your information if it changes. You are responsible for all activity that occurs under your account.

We may require identity, ownership, or payment verification before enabling certain features, restoring access, or responding to sensitive support requests.

3. Early access, invite-only access, and beta features

ASAP Motion may be offered in invite-only, preview, early-access, or beta form. We may add, remove, pause, limit, or modify features, templates, models, export paths, or plan entitlements at any time, especially while the Service is still evolving.

Beta and preview features may be incomplete, unstable, or unavailable in some regions, devices, or browsers. They are provided for evaluation and creative experimentation and may be withdrawn without liability.

4. The Service

ASAP Motion is a browser-based creative platform that lets users generate, edit, store, render, and export motion graphics and related creative assets. Features may include prompt based generation, editable templates, uploaded reference media, project persistence, browser-side export, server-side rendering, and model or engine selection.

We may set or change technical, creative, or commercial limits such as project duration, export resolution, render concurrency, model availability, generation frequency, storage, watermarking, rate limits, or API availability.

5. Your inputs, uploads, and instructions

"Inputs" means the prompts, text, files, images, video, audio, brand assets, reference media, project edits, instructions, and other material you submit to the Service. You keep responsibility for your Inputs.

You represent and warrant that:

  • you own or have all rights, licenses, permissions, and consents needed for your Inputs
  • your Inputs and your use of them will not infringe, misappropriate, or violate any law or third-party right
  • you will not submit confidential or regulated data unless you have authority to do so and it is lawful
  • you will not submit material involving minors, biometric identifiers, health data, payment data, or government IDs in ways that violate law or platform rules

You grant ASAP Motion a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, adapt, display, and otherwise use your Inputs and related project data as needed to operate, secure, maintain, troubleshoot, improve quality, and support the Service, and to provide the specific generation, rendering, editing, and export actions you request.

6. Generated output and your review obligations

The Service may generate code, compositions, text, animation sequences, layouts, timing, captions, transitions, styling, exports, thumbnails, and other outputs based on your Inputs. AI generated output can be inaccurate, offensive, unavailable, low quality, incomplete, or similar to output provided to other users.

You are solely responsible for reviewing all output before you publish, distribute, advertise, rely on, or otherwise use it. That includes checking for factual accuracy, clearances, legal disclosures, accessibility, trademark issues, copyright issues, licensing restrictions, synthetic-media disclosures, and fitness for your intended use.

ASAP Motion does not guarantee that output will be original, available for copyright protection, non-infringing, merchantable, uninterrupted, or suitable for any particular campaign, channel, audience, or commercial purpose.

7. Ownership and licenses

As between you and ASAP Motion, you retain whatever rights you have in your Inputs. Subject to your compliance with these Terms and to the rights of third parties, ASAP Motion assigns to you any rights we may have in output generated specifically for your use from your Inputs.

The assignment above does not apply to, and you do not receive ownership of:

  • ASAP Motion software, site design, workflows, user interface, and service architecture
  • our trademarks, branding, logos, names, and trade dress
  • pre-existing templates, template systems, stock elements, example scenes, and preset libraries except as embedded in your permitted final export
  • third-party content, fonts, libraries, models, voices, likenesses, media, or other materials subject to separate rights

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and any included templates or tools only as permitted by these Terms. You may not resell, sublicense, scrape, clone, or redistribute the Service or template library on a standalone basis.

8. Projects, storage, and exports

The Service may store projects, scenes, messages, prompts, editable properties, export settings, and related creative history so you can continue work later. You should maintain your own backups of any content that is important to you. The Service is not an archival or guaranteed backup system.

Export behavior, resolution, codecs, watermarks, render speed, and availability may vary by browser, device, plan, project complexity, file size, third-party dependencies, or server capacity. We may refuse or interrupt exports that threaten service stability, exceed limits, or appear abusive.

If you publish or distribute exports created with ASAP Motion, you remain responsible for all legal disclosures, permissions, clearances, ad standards, platform policies, and local synthetic-media or endorsement rules that apply to your use case.

9. Acceptable use

You may not use ASAP Motion to, or attempt to:

  • break the law or violate another person's intellectual property, privacy, publicity, or other rights
  • generate, upload, or distribute content that is fraudulent, defamatory, hateful, exploitative, harassing, obscene, or sexually exploitative
  • create deceptive impersonations, election disinformation, or undisclosed synthetic media where disclosure is required
  • upload malware or code intended to damage, surveil, intercept, or gain unauthorized access
  • reverse engineer, probe, benchmark, scrape, mirror, frame, copy, or derive source code from the Service except to the extent prohibited by law
  • circumvent credits, rate limits, invite controls, usage caps, watermarking, model restrictions, or account restrictions
  • interfere with the Service, bypass security, or use automation that imposes unreasonable load
  • use the Service to develop or improve a competing product using our templates, outputs, or product behavior at scale without permission

We may investigate, monitor, remove content, disable projects, restrict model access, or suspend accounts if we believe misuse, fraud, security issues, or legal risk are present.

10. Plans, credits, and usage limits

ASAP Motion may offer free, paid, promotional, invite-only, or custom plans. Plans may differ by credits, generation limits, export limits, duration, resolution, watermarking, storage, model access, API access, support level, and template access.

Credits are a limited contractual measure of feature access. Credits are not bank accounts, gift cards, deposits, stored value, or personal property; except where required by law, they are not redeemable for cash, non-transferable, and may expire or reset according to the plan or offer under which they were provided.

We may deduct credits when you initiate or complete certain generation, correction, rendering, or premium actions. We may restore credits for some failed or materially incomplete requests in our discretion or where required by law. Abuse of credits, multiple free accounts, account sharing, or attempts to bypass plan limits is prohibited.

11. Paid plans, renewals, cancellations, and refunds

Some paid plans shown on the site may be marked as coming soon, early access, or not yet available for purchase. If and when ASAP Motion enables paid purchases, the applicable pricing, billing frequency, included entitlements, taxes, trial terms, renewal terms, and cancellation instructions presented at checkout will become part of your purchase terms.

If you enroll in an automatically renewing plan, you authorize recurring charges using your selected payment method until you cancel. We will present material subscription terms clearly before charge authorization, provide an acknowledgment after sign-up, and offer a cancellation method that is reasonably easy to use and at least compliant with applicable law.

Unless we expressly state otherwise, subscriptions renew for successive periods equal to the initial term, upgrades may take effect immediately or at the next billing cycle depending on the offer, downgrades may take effect at renewal, and unused credits or unused feature allowances do not roll over.

Except where required by law or expressly stated in writing, fees are non-refundable, taxes are your responsibility, and partial billing periods are not prorated. We may change prices or plan inclusions prospectively after advance notice.

12. Third-party services and dependencies

ASAP Motion relies on third-party providers for infrastructure, authentication, data storage, analytics, media delivery, payments, model access, rendering, and other core functions. Your use of certain features may therefore also be subject to third-party terms, platform rules, or technical restrictions.

We are not responsible for delays, outages, model changes, API failures, browser issues, data loss, policy changes, or other problems caused by third-party services that are outside our reasonable control.

13. Feedback

If you send us ideas, suggestions, feature requests, corrections, design notes, or other feedback, you grant ASAP Motion a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish, and exploit that feedback without restriction or compensation to you.

14. Intellectual property complaints

If you believe content available through the Service infringes your intellectual property rights, contact us at asapmotiondev@gmail.com with enough detail for us to identify the material, evaluate the claim, and reach you. We may remove or disable access to content, notify the affected user, request additional information, and terminate repeat infringers when appropriate.

If you operate in the United States and want to rely on the Digital Millennium Copyright Act, you are responsible for providing accurate notices and counternotices. ASAP Motion may maintain a designated DMCA agent if and when required or appropriate for its operations.

15. Suspension and termination

You may stop using the Service at any time. We may suspend, restrict, or terminate access, remove content, or disable projects immediately if we reasonably believe that you violated these Terms, created legal or security risk, misused credits or invite access, failed to pay applicable fees, or threatened the integrity of the Service or other users.

After termination, your right to access the Service stops immediately. We may retain or delete account data, project data, logs, or transactional records as permitted or required by law and as reasonably needed for security, audits, dispute resolution, or compliance.

16. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR LOSS-FREE.

We do not warrant that prompts will succeed, output will compile or render, exports will be preserved, model behavior will remain consistent, or that any output will satisfy legal, professional, advertising, or accessibility requirements.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASAP MOTION AND ITS AFFILIATES, FOUNDERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CONTENT, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ASAP MOTION FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so some of the limitations above may not apply to you.

18. Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless ASAP Motion and its affiliates, founders, employees, contractors, suppliers, and licensors from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your Inputs, your outputs, your exports, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

19. Governing law and disputes

These Terms are governed by the laws that apply where ASAP Motion is headquartered, without regard to conflict-of-laws rules, except to the extent consumer protection law in your place of residence requires otherwise.

Before filing a formal claim, you and ASAP Motion agree to try to resolve the dispute informally by contacting the other party with a written description of the issue and the requested resolution. If we cannot resolve the dispute informally, then, unless applicable law requires otherwise, the dispute must be brought exclusively in the state or federal courts that have jurisdiction over ASAP Motion's principal place of business, and each party consents to personal jurisdiction there.

20. Changes to the Service or these Terms

We may change the Service, these Terms, or any plan, feature, limit, or policy from time to time. If we make a material change, we may provide notice by posting the updated Terms on the site, updating the effective date, sending an email, or providing in-product notice.

Your continued use of the Service after the effective date of updated Terms means you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

21. General terms

These Terms are the entire agreement between you and ASAP Motion regarding the Service and supersede prior or contemporaneous understandings on that subject.

If any provision of these Terms is found unenforceable, the rest will remain in effect. A failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our prior written consent, but we may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
